Man Admits Breaking Into Business and Trying to Steal, Now He’s Suing the Owner for $10 Million After Being Shot
A man who admits he broke into a Portland business and intended to steal property is now suing the business and its owner for $10 million after the owner shot him multiple times during the encounter.
Kenneth Voyles filed the lawsuit against Touchstone Granite & Marble Inc. and its owner, James Grant, accusing them of battery, assault, negligence and intentional infliction of emotional distress.
Voyles is seeking $5 million in compensatory damages and another $5 million in punitive damages.
The incident happened at the Portland, Oregon, business on March 6, 2023.
Voyles, who was homeless at the time, says he was cold and sleep-deprived when he entered the closed business through a damaged portion of a garage door looking for warmth and food.
But Voyles also admits he was trespassing and picked up a drill bag that he intended to keep.
What happened next is disputed.
Voyles claims Grant confronted him inside the business and that he immediately apologized and attempted to leave. He alleges Grant threw a coffee mug and heavy tiles at him as he ran toward the garage door.
Voyles says he then picked up a pair of bolt cutters to protect himself after he was unable to open the locked door.
According to the lawsuit, Grant left the area, returned with a handgun and shot Voyles multiple times without warning.
Voyles alleges Grant told him he was going to die before shooting him in the chest at close range and firing again as Voyles attempted to escape through the damaged garage door.
Grant has given a very different account of what happened.
The business owner said he discovered Voyles inside his upstairs office and followed him toward the back of the warehouse. Grant said Voyles then became aggressive, raised the bolt cutters and began coming toward him.
Grant said he believed his life was in danger and repeatedly ordered Voyles to get on the ground, but Voyles refused.
Voyles survived the shooting but suffered serious injuries, including a collapsed lung and shattered bones in his right arm that required multiple surgeries.
He is now asking a court to hold Grant and the business financially responsible for those injuries.
The lawsuit seeks a combined $10 million in damages and remains pending.
